1. Introduction

Welcome to Eden Resort, located in the heart of Kajiado, Kenya. These Terms of Service govern your use of our resort facilities, services, and website. By making a booking, checking in, or using any of our services, you agree to be bound by these terms.

Eden Resort is dedicated to providing a sustainable, nature-centered experience. These terms help ensure the safety, comfort, and enjoyment of all our guests while protecting the natural environment we cherish.

2. Booking & Cancellations

2.1 Reservations

  • All bookings are subject to availability and confirmation
  • A valid credit card or deposit may be required to secure your reservation
  • You must be at least 18 years old to make a booking
  • We reserve the right to refuse any booking at our discretion

2.2 Cancellation Policy

Within 2-3 days of check-in 50% refund 50% of total booking cost
Less than 2 days before check-in or no-show No refund Full booking charge applies
Early departure No refund for unused nights Full charge for booked period

Important: All cancellation requests must be made in writing via email to edenresorthutias@gmail.com. The cancellation date is determined by when we receive your written request.

2.3 Modifications

  • Date changes are subject to availability and rate differences
  • Modifications within 2 days of check-in may be treated as cancellation
  • Room upgrades or downgrades are subject to availability

3. Check-In & Check-Out

3.1 Standard Times

  • Check-in: 12:00 pm (noon) onwards
  • Check-out: 11:00 am

3.2 Early/Late Arrivals & Departures

  • Early check-in is subject to availability and may incur additional charges
  • Late check-out requests must be made in advance and are subject to availability
  • Quiet hours are observed from 10:00 pm to 7:00 am

3.3 Identification Requirements

  • Valid government-issued photo ID (passport or national ID) is required at check-in
  • International guests must present a valid passport with appropriate visa
  • We are required by law to register all guests with local authorities

4. Guest Responsibilities

As a guest at Eden Resort, you are expected to uphold the following responsibilities to ensure a safe, respectful, and sustainable environment for all:

4.1 Respect for Nature and Community

  • Treat the natural surroundings, wildlife, staff, and fellow guests with courtesy and care
  • Avoid actions that may harm the environment or disrupt others' experiences
  • Respect local customs and cultural sensitivities

4.2 Sustainable Practices

  • Conserve water and electricity by turning off lights, AC, and taps when not in use
  • Use eco-friendly amenities provided (biodegradable soaps, solar showers)
  • Participate in resort sustainability initiatives where possible

4.3 Facility Use

  • Use all resort facilities and equipment responsibly and for their intended purpose
  • Children must be supervised at all times to ensure their safety and the safety of others
  • Report any damaged or malfunctioning equipment to staff immediately

4.4 Health and Safety

  • Follow all posted safety guidelines and instructions from staff
  • Refrain from engaging in illegal activities or disruptive behavior
  • Use provided safety equipment when participating in activities

4.5 Waste Management

  • Dispose of waste properly using designated bins (separate recycling where available)
  • Do not litter or damage the natural landscape
  • Minimize single-use plastics and other non-biodegradable materials

4.6 Wildlife Interaction

  • Observe wildlife respectfully from a safe distance
  • Do not feed animals or interfere with their natural behavior
  • Follow staff guidance during wildlife encounters

4.7 Digital Conduct

  • Use Wi-Fi and digital resources responsibly
  • Avoid illegal downloads or misuse of shared bandwidth
  • Respect others' privacy when taking photos or videos

Consequences of Non-Compliance: Failure to comply with these responsibilities may result in eviction from the resort without refund, additional charges for damages, or other appropriate actions as determined by resort management.

5. Eco-Ethical Expectations

As an eco-conscious resort, we have specific expectations for all guests to minimize environmental impact:

5.1 Energy and Water Conservation

  • Limit shower times to conserve water (solar-heated water is limited)
  • Turn off lights, fans, and electrical appliances when leaving your room
  • Use natural ventilation when possible instead of air conditioning

5.2 Waste Reduction

  • Use refillable water bottles instead of single-use plastics
  • Participate in our composting and recycling programs
  • Minimize food waste by ordering only what you can consume

5.3 Natural Environment

  • Stay on marked trails during hikes and nature walks
  • Do not remove plants, rocks, or other natural materials
  • Use biodegradable sunscreen and insect repellent when swimming in natural water bodies

6. Use of Facilities

6.1 General Rules

  • All facilities must be used responsibly and in accordance with posted instructions
  • Guests use facilities at their own risk
  • Proper attire is required in all public areas

6.2 Specific Facilities

  • Swimming areas: No lifeguard on duty. Children must be supervised
  • Fitness equipment: Use proper form and safety precautions
  • Dining areas: Respect meal times and other guests
  • Activity equipment: Return in the same condition as borrowed

6.3 Children

  • Children under 12 must be supervised by an adult at all times
  • Some activities may have age restrictions for safety reasons
  • Parents/guardians are responsible for their children's behavior and safety

7. Safety & Conduct

7.1 Prohibited Activities

  • Illegal activities of any kind
  • Disruptive behavior that disturbs other guests
  • Smoking in non-designated areas (specific smoking zones are provided)
  • Bringing pets without prior authorization (service animals excepted)
  • Use of fireworks, firearms, or other dangerous items

7.2 Right to Evict

The resort reserves the right to evict guests who:

  • Endanger others or breach safety rules
  • Cause significant damage to property
  • Engage in illegal activities
  • Violate these Terms of Service repeatedly

In such cases, no refund will be provided for unused portions of the stay.

7.3 Wildlife Encounters

  • Wildlife sightings are part of the natural experience
  • Do not approach, feed, or attempt to touch wild animals
  • Follow staff instructions during wildlife encounters
  • Store food securely to avoid attracting animals to guest areas

8. Wi-Fi & Digital Use

8.1 Availability

  • Limited Wi-Fi is available in designated areas only
  • Connectivity is through 4G and may be limited to preserve the natural setting
  • We cannot guarantee continuous or high-speed internet access

8.2 Acceptable Use

  • Use Wi-Fi responsibly for reasonable personal use
  • Do not download or stream large files during peak hours
  • Respect bandwidth limits to ensure fair access for all guests

8.3 Prohibited Activities

  • Illegal downloads or uploads
  • Accessing inappropriate or illegal content
  • Hacking, spamming, or other malicious activities
  • Commercial use without prior authorization

9. Liability Waiver

Eden Resort is not liable for:

  • Loss or theft of personal property: Use in-room safes for valuables
  • Weather interruptions: Natural phenomena may affect activities
  • Travel delays or acts of nature: We cannot control external factors
  • Injuries incurred through personal negligence: Use facilities responsibly
  • Illness or health issues: Consult your doctor before travel
  • Third-party services: We're not liable for external tour operators

Important: By using our facilities and participating in activities, you acknowledge and accept inherent risks associated with nature-based tourism and resort activities. You agree to release Eden Resort, its owners, employees, and affiliates from any claims arising from such risks.

10. General Provisions

10.1 Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kajiado County.

10.2 Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

10.3 Entire Agreement

These Terms of Service constitute the entire agreement between you and Eden Resort regarding your stay and use of our services, superseding any prior agreements or understandings.

10.4 Updates to Terms

We may amend these Terms of Service from time to time. The updated version will be posted on our website with a revised effective date. Continued use of our services after changes constitutes acceptance of the new terms.
